General conditions of sale
- These General Conditions of Sale (hereinafter, the General Conditions) have as their object the regulation of the purchase of products and services, carried out remotely and made available, through internet network, from the site www.nautica21nodi.it (hereinafter, the Site or Nautica 21 Nodi).
- The products made available by the Site consist of various types of nautical accessories, electronics, books, DVDs, etc.; the services made available by the Site are those connected with the sale of the aforementioned products. All the products and services offered are illustrated on the Site (www.nautica21nodi.it ).
- The owner of the site is Nautica 21 Nodi S.r.l. (hereinafter, Nautica 21 Nodi), with registered office in Via A. De Gasperi, 249/b, 80053 Castellammare di Stabia (NA), VAT number and CF: 08501411212 who is the owner and holder of all rights to the brand. All purchases of products and services made through the Site (hereinafter, the Purchase Contracts) by users who access it (hereinafter, the Customers) are governed solely by the General Conditions.
- The Customer is required to carefully read the Conditions of Sale that Nautica 21 Nodi also makes available to him in order to allow the reproduction and storage of the mentioned Conditions in compliance with the provisions of the art. 12, co. 3rd of Legislative Decree no. 70/2003.
- Nautica 21 Nodi may modify, at any time and without notice, the content of the General Conditions referred to in this document. Any changes made will take effect from the date of publication on the Site, as declared in the heading of the General Conditions themselves.
How to purchase
- The Customer can purchase the products present in the Nautica 21 Nodi electronic catalogue, illustrated in detail on the Site, respecting the technical access procedures illustrated therein. The publication of the products and services displayed on the site constitutes an invitation to the Customer to formulate a contractual purchase proposal. The order sent by the Customer has the value of a contractual proposal and entails complete knowledge and full acceptance of these General Conditions.
- The correct receipt of the Customer's proposal is confirmed by Nautica 21 Nodi through an automatic response sent to the email address communicated by the Customer. The response from Nautica 21 Nodi is automatically generated by the Site system and only confirms the correct reception of the proposal within the information systems. This confirmation message will indicate the expected day of shipment and a "Customer Order Number", to be used in any subsequent communication with Nautica 21 Nodi. The message presents, in addition to the information required by law, all the data entered by the Customer who undertakes to verify its correctness and promptly communicate any corrections.
- Each Purchase Contract stipulated between Nautica 21 Nodi and the Customer must be considered concluded with the acceptance of the order by Nautica 21 Nodi. Nautica 21 Nodi has the right to accept or not, at its discretion, the order sent by the Customer, without the latter being able to make any claims or rights of any kind, for any reason, in the event of non-acceptance of the order itself. Nautica 21 Nodi's acceptance is considered tacitly granted, unless otherwise communicated to the Customer within 96 hours of sending the order, by means of an e-mail message sent to the address communicated by the Customer.
- By sending the order, in the various ways provided for by the operating instructions of the Site, the Customer declares to have read all the information provided to him during the purchasing procedure. purchase, and to fully accept the General and Payment Conditions described below.
Product prices – delivery costs - product availability
- All product prices are clearly indicated on the Site and include VAT.
- The prices and availability of the products, as shown on the Site, are subject to change at any time and without notice, it being understood that, limited to orders being accepted or as above accepted by Nautica 21 Nodi, the conditions of sale in force at the time the order is sent by the Customer will apply.
- The Site highlights the products available for shipping according to the methods indicated in the appropriate section. This product availability is not updated in real time; furthermore, in consideration of the possible simultaneous access to the Site by many users, the actual availability of individual products may vary significantly during the same day compared to the indications shown on the Site. Nautica 21 Nodi does not assume any commitment nor guarantee the certainty of immediate delivery of the delivery of the products purchased and indicated as available on the Site and therefore it will in no case be responsible for any delays in delivery.
- The cost of each shipment, the amount of which may vary based on the delivery and payment method as well as the country of destination and the total amount of the order, adds to the total price of each Purchase Contract and is clearly indicated and communicated to the Customer, through the Site, before the conclusion of the Purchase Contract.
Payments
Payments in execution of Contracts Purchases made through the Site can be made exclusively by credit card, cash on delivery, Afterpay or PayPal. The Customer is required to choose, at the time of conclusion of the Purchase Contract, the chosen payment method. The latter, once the Purchase Contract has been finalized through acceptance by Nautica 21 Nodi, can no longer be modified.
Credit card
The following credit cards are accepted : Visa, Mastercard and Maestro.
Online credit card transactions they are carried out directly on the bank portal, via a secure server, so no one can interpret your ch dataand travel on the Internet.
Nautica 21 Nodi charge on the credit card only when the goods are shipped. No commissions apply for credit card payments.
Mark
Payment for products purchased at the same time as delivery of the same (hereinafter, Cash on Delivery) must be carried out exclusively with cash in Euros to the courier who will carry out the delivery. It will be the Customer's responsibility to prepare the exact sum indicated at the time of completion of the Purchase Contract. The courier usually does not have change. Bank checks, bank drafts or other means of payment will not be accepted under any circumstances.
In case of non-payment by of the Customer of the agreed price, for any reason or cause, Nautica 21 Nodi will invite the Customer in writing to pay the balance and will have the right to charge the Customer a late payment interest equal to that provided by law; in this case, until the Customer has settled his debt position with Nautica 21 Nodi, the latter also reserves the right to cancel any subsequent deliveries of products, to terminate any existing Purchase Contracts as well as to block the purchase functions through the Site, without prejudice to compensation for any further damage.
Afterpay
Scalapay is an innovative payment method which allows the customer to purchase in online stores, receive the products immediately and pay in 3 convenient equal monthly installments. The service has no additional costs for the customer if the installments are paid by the due date. At the time of purchase, the first installment will be charged immediately (equal to one third of the total value of the purchase). The next 2 installments will be charged monthly.
First instalment: at the time of purchase.
Second installment: 1 month from the day of purchase.
Third and final installment: 2 months from the day of purchase.
PayPal
All major cards are accepted credit and it is not necessary to have a Paypal account. Transactions are carried out directly on Paypal's secure servers, the world's leading site for secure online payments. No commissions apply for credit card payments.
Delivery and documentation
- All product deliveries will be at the risk of Nautica 21 Nodi. The risk will transfer to the Customer upon delivery of the products to the Customer by the shipper, carrier or other agent appointed by Nautica 21 Nodi for delivery.
- No responsibility, for any reason, can be charged by the Customer to Nautica 21 Nodi in case of delay in processing the order or in delivering the products covered by the Contracts Purchase.
- The delivery of the products is intended at street level. Upon delivery of the products by the courier appointed by Nautica 21 Nodi, the Customer is required to check (a) that the number of packages delivered corresponds to what is indicated in the transport document and (b) that the packaging is intact , not damaged or otherwise altered, even in the closing materials.
- Any damage to the packaging and/or products or the mismatch in the number of packages or indications must be immediately contested by the Customer, adding the writing "ACCEPTED WITH RESERVATION" on the courier's delivery receipt. Furthermore, the Customer undertakes to promptly report - and in any case no later than 8 (eight) days from the date of delivery - to Nautica 21 Nodi (by sending a message to info@nautica21nodi.it) any and all problems relating to the physical integrity, correspondence or completeness of the products received.
- Cases of force majeure, unavailability of goods or means of transport, as well as unforeseeable or unavoidable events which cause a delay in deliveries or make deliveries difficult or impossible or which cause a significant increase in the delivery cost borne by Nautica 21 Nodi will give Nautica 21 Nodi the right to split, postpone or cancel, in whole or in part, the expected delivery or to terminate the Purchase Contract. In such cases, Nautica 21 Nodi will provide timely and adequate communication of its decisions to the email address indicated by the Customer and the latter will have the right to a refund of any price already paid, excluding any further claim, for any reason, against Nautica 21 nodi.

Proprietary Rights intellectual
All trademarks (registered or non), as well as any intellectual work, distinctive sign or name, image, photograph, written or graphic text and more generally any other intangible asset protected by laws and international conventions regarding intellectual property and reproduced industrial property on the Site remain the exclusive property of Nautica 21 Nodi and/or its assignees, without the Customer having any rights over the same from access to the Site and/or from the stipulation of the Purchase Contracts. Any use, even partial, of the same is prohibited without the prior written authorization of Nautica 21 Nodi, in whose favor all related rights are exclusively reserved.
Applicable law – Jurisdiction
The Purchase Agreement between the Customer and Nautica 21 Nodi is understood to be concluded in Italy and regulated by Italian law. For any disputes that may arise between Nautica 21 Nodi and the Customer, the Judge of the place of residence or domicile of the consumer will be competent if located in the territory of the State. For Customers domiciled in European Union states, the articles will apply. 15-17 Reg. 44/01 EU. For customers domiciled outside the European Union, the Court of Rimini will be exclusively competent.
Data processing personal (Privacy)
To be able to purchase the products on site it is necessary to provide the personal data requested in the appropriate form. Upon registration, the user is assigned a personal login and password through which he or she is identified when accessing the website.
The data provided when of the registration are processed by Nautica 21 Nodi and for the purposes and in the manner described below and in any case in full compliance with Legislative Decree 196/2003 (Code regarding the processing of personal data) and its subsequent amendments. The personal data provided are processed for the following purposes:
- Duties related to the stipulation and execution of the contract, statistical purposes and sending of advertising material, also through the use of e-mail.
- The processing of data for the purposes set out takes place both with automated and non-automated methods for the time necessary to achieve the purposes for which they were collected. Specific safety measures are observed to preventto loss of data, illicit or incorrect use and unauthorized access. The provision of personal data by the user is optional. Any refusal to provide data for the purposes referred to in letter a) of the previous point 3 will make it impossible to purchase the Products on the Site. On the contrary, any refusal to provide data for the purposes referred to in letter b ) does not determine any consequences on the possibility of purchasing the Products on the Site.
- Nautica 21 Nodi takes the protection of privacy seriously, i.e. the confidentiality of the personal data of its users. The data will be collected only where necessary and in compliance with current legislation. Nautica 21 Nodi will always provide clear information relating to the use that is made of your personal data and will always be transparent with users regarding the data that is collected, the use that is made of it, with whom it is shared and the office to be contact for any request.
